Terms of Service

1. Service Description

Pet Portraits AI (operated by PunchLab, Luca Restagno, München, Germany) is an AI-powered digital tool that transforms your pet photos into artistic portraits across multiple art styles. The service is provided entirely digitally; no physical goods are shipped. Results are generated by artificial intelligence and may vary in style and likeness.

2. Age Requirement

You must be at least 18 years old to use this service. By placing an order you confirm that you meet this age requirement.

3. Payment

The service costs €3.99 per order (10 AI portraits in all styles). Payments are processed securely by Stripe (Stripe Payments Europe, Ltd., Dublin, Ireland), which acts as payment processor. We never see or store your card details. All prices include applicable VAT.

Your contract is concluded with PunchLab upon successful payment. Stripe sends a receipt to your email address on our behalf.

4. Delivery and Right of Withdrawal

Generation of your AI portraits begins immediately after payment is confirmed. By placing an order you expressly agree that performance of the digital service begins immediately, and you acknowledge that your right of withdrawal lapses upon commencement of generation pursuant to § 356(5) BGB / Art. 16(m) Consumer Rights Directive.

If a technical fault on our side prevents delivery of your portraits, contact us at hello@punchlab.dev and we will resolve the issue or issue a full refund.

5. Your Content and Ownership

You must hold all necessary rights to any photos you upload. By uploading, you confirm that you own the photos or have explicit permission from the rights holder.

We do not claim any ownership over your uploaded photos or the AI-generated portraits. The generated portraits are delivered to you for personal use. You may use them freely for personal, non-commercial purposes. Commercial use (e.g. selling prints, merchandise) requires a separate written agreement.

All uploaded photos and generated portraits are automatically deleted within 24 hours. Generated portraits are available for download for up to 7 days. Please download your results promptly.

6. Prohibited Use

You must not use this service to:

• Upload photos of people without their explicit consent
• Create deepfakes or misleading synthetic media of real individuals
• Upload or generate illegal, obscene, or harmful content
• Violate any intellectual property rights
• Attempt to reverse-engineer, scrape, or overload the service
• Use the service for any purpose prohibited by applicable law

We reserve the right to refuse processing of any content that we determine, at our sole discretion, to violate these requirements or applicable law.

7. Intellectual Property

All content, design, and software on this website (excluding your uploaded photos and generated portraits) is owned by PunchLab and protected by copyright. Reproduction or commercial use without written consent is prohibited.

8. Limitation of Liability

Pet Portraits AI is provided "as is". AI-generated portraits are artistic interpretations — not professional artwork — and results may vary. We do not guarantee a specific likeness or artistic outcome.

To the extent permitted by law, PunchLab's liability for damages arising from use of this service is limited to the amount paid for the relevant order. This limitation does not apply to damages caused by wilful misconduct or gross negligence, nor does it affect your statutory rights under EU and German consumer protection law.

9. Service Availability

We aim to keep the service available at all times but do not guarantee uninterrupted operation. Planned or unplanned maintenance may cause temporary unavailability. In the event of extended downtime after payment, we will issue a refund.

10. Changes to These Terms

We may update these Terms at any time. Changes take effect upon posting to this page. Your continued use of the service after changes constitutes acceptance of the updated Terms.

11. Governing Law and Jurisdiction

These Terms are governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes arising from or in connection with these Terms is Munich, Germany, insofar as you are a merchant, a legal entity under public law, or a special fund under public law. Statutory mandatory consumer protection provisions of your country of residence remain unaffected.

The European Commission provides an online dispute resolution (ODR) platform: ec.europa.eu/consumers/odr. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
